In my experience infantry do fire when their ammo is low, but only when defending themselves, and their rate of fire i.e. the "number of times" they fire during a turn is lower then when not out of ammo. Furthermore I've got the impression that their weight of fire is lower then when they're not out of ammo. It seems that opposing infantry is less affected by fire form infantry out of ammo then form infantry which isn't.

Didn't run any tests on the subject though...
